Visitor Clarification Text on the Processing of Personal Data
Dear Visitor, we would like to inform you within the scope of the Personal Data Protection Law.
Pursuant to the Personal Data Protection Law No. 6698 ("PDPL"), all information that identifies or makes you identifiable, including your special category personal data, may be processed by FENESE KALIP PLASTİKMETAL SANAYİ VETİC.LTD.ŞTİ. ("Company") as the data controller.
The processing of personal data refers to any operation performed on data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, classifying, or preventing the use of personal data.
The protection of your personal data is of vital importance to us. We would like to inform you that we will take all necessary measures in this regard and will continue to be fully transparent.
Purposes of Processing Personal Data
Your collected personal data may be processed for purposes such as ensuring the legal and commercial security of our Company and persons with whom our Company has a business relationship, ensuring the physical security of the factory premises by our Company, creating and monitoring visitor records, ensuring the security of data controller operations, carrying out storage and archiving activities, fulfilling notification obligations to relevant/authorized public institutions (such as courts and law enforcement), and fulfilling Occupational Health and Safety obligations pursuant to Law No. 6331. For these purposes, your image, identity, and contact data may be recorded.
Transfer of Your Personal Data
Your data is processed and securely stored for the purposes listed above, and is strictly not shared with third parties except for notification obligations to public institutions, legal regulations, and your explicit consent. Your personal data may be transferred to authorized public institutions/organizations due to obligations arising from legal regulations such as SGK, Labor Law No. 4857, Tax Procedure Law, Turkish Commercial Code, and OHS Law; to intermediary companies from which we receive services regarding information systems and/or physical security; to our business partners, shareholders, and local/international organizations from which we receive support in our business processes, within the framework of legal grounds and your consent.
Method of Collecting Your Personal Data
Your personal data is collected by our Company through various channels and based on different legal reasons for the purpose of conducting our commercial activities and ensuring the security of our premises and yourself. In this context, it is collected through various methods including closed-circuit video surveillance systems and visitor registration forms, verbally, in writing, or electronically, and may also be obtained from outside FENESE KALIP PLASTİKMETAL SANAYİ VETİC.LTD.ŞTİ., including from program partner institutions and organizations we collaborate with, official institutions, and other third parties.
Your Rights Listed Under Article 11 of the PDPL
As personal data owners, in the event that you submit your requests regarding your rights to our Company through the methods set out below in this Clarification Text, our Company will finalize the request free of charge as soon as possible and within 30 days at the latest, depending on the nature of the request. However, if a fee is stipulated by the Personal Data Protection Board, the fee in the tariff determined by our Company will be charged.
In this context, you have the right to: a) Learn whether your personal data is being processed, b) Request information if your personal data has been processed, c) Learn the purpose of processing your personal data and whether it is used in accordance with its purpose, d) Know the third parties to whom personal data is transferred domestically or abroad, e) Request the correction of incomplete or incorrectly processed personal data and request that the transaction carried out within this scope be notified to the third parties to whom personal data has been transferred, f) Request the deletion or destruction of personal data in the event that the reasons requiring its processing cease to exist, even if it has been processed in accordance with the PDPL and other relevant laws, and request that the transaction carried out within this scope be notified to the third parties to whom personal data has been transferred, g) Object to a result that is to the detriment of the person themselves arising from the analysis of processed data exclusively through automated systems, h) Request the compensation of damages in the event of damage due to unlawful processing of personal data.
Data Controller and Methods for Data Subject Information Requests
You may submit your request regarding the exercise of the rights mentioned above as required by the PDPL, in writing or through other methods determined by the Personal Data Protection Board, via the channels specified below.
As the data subject, you are required to submit your rights requests to our Company in writing, along with the necessary documents to verify your identity. In this context, in order for your applications to our Company under Article 11 of the PDPL to be handled accurately and promptly, we recommend using the "Data Subject Information Request Form" document under the Personal Data Protection heading at www.fenese.com, and submitting it in person or via registered mail with return receipt, along with the documents/information that may be requested based on your request and the necessary identity verification documents. As a data subject, you are required to submit your information requests in writing using the "Data Subject Information Request Form" on our website, in accordance with the methods determined and to be determined by the Personal Data Protection Law No. 6698 and the Personal Data Protection Authority.
